TERMS AND CONDITIONS
Conditions of Chocolate Moment
• These Terms and Conditions do not affect your statutory rights.
• Chocolate Moment may make changes to the Terms and Conditions; therefore, it is the responsibility of the user to check what alterations have been made. Your continued use of chocolatemoment.co.uk, after any changes to the Terms and Conditions have been made, will indicate your acceptance of the changes to these terms.
• Chocolate Moment retains the right to modify, terminate or suspend any content or part of the website.
• Confirmation of your order shall be acknowledged by e-mail, and will confirm buyers name, delivery address, total value of goods and delivery costs.
• Acceptance of your order shall be acknowledged when payment has been processed. Thereafter, your order will be dispatched.
• Any measurements, such as the dimension, weights and volumes declared on the website are correct to the best of our knowledge and have been obtained from the product manufacturers.
• The prices of all products are correct. Chocolate Moment cannot be held responsible for any pricing errors, or price increases made by our suppliers. Prices of all products will be kept up to date and Chocolate Moment retains the right to make changes to the price where necessary.
• If for any reason there is an error with the price of your order, Chocolate Moment will inform you. We will allow you the option of accepting the correct price or canceling your order. However, if an error with the price is acknowledged after goods have been dispatched then the error will be rectified accordingly. Refund of the amount over the correct price will be made by Chocolate Moment or payment of the outstanding amount will be made by the customer.
• All products at Chocolate Moment are subject to availability. Due to certain circumstances Chocolate Moment may not hold the product you require, in which case we will contact you. A replacement item of the same value as your order will be offered and dispatched on the next working day should you accept.
Payment
• All payments will be accepted in Pounds Sterling (GBP).
• Chocolate Moment accept payments made by credit or debit card.
• Goods will not be despatched until all payments have been cleared. All goods remain the property of Chocolate Moment, until full payment has been received.
• The total payment shall include all packaging costs.
• If we are unable to despatch your order, we will contact you with the offer of a replacement, or the option to cancel all or part of your order. In this case Chocolate Moment shall refund the outstanding balance.
• Credit card details will not be kept in store by Chocolate Moment.
• Before confirming and submitting the order to Chocolate Moment, you will have a number of opportunities to correct any errors made when entering your order, name, or delivery address.
• 15% VAT is added to all orders made from the UK.
Credit Card Security
• All credit and debit card payments are processed by our secure credit card processing facility with Protx.
• All transactions are encrypted using 128-bit SSL certificates.
• No cardholder information is ever passed unencrypted.
• Messages sent from Protx are signed using MD5 hashing to prevent tampering.
• Protx servers do not allow transaction information to be examined, used or modified by any third parties attempting to gain access to sensitive information.
Delivery
• We do not guarantee delivery times as they are governed by our carriers; however UK deliveries generally arrive within 1-3 days of dispatch. Chocolate Moment cannot be held responsible for delays caused by delivery companies. We retain the right to change courier and service at our discretion.
• All orders received by 1p.m Monday – Friday will be despatched the same day to be delivered on the next working day. Any orders received after 1p.m Monday – Friday will be despatched on the next working day.
• We will try our best to deliver your order on the next working day between 9a.m and 5.30.pm.
• Orders for any products are not despatched on Saturday, Sunday, Bank and Public Holidays.
• Due to certain circumstances Chocolate Moment may not hold the product you require, in which case we will contact you. A replacement item of the same value as your order will be offered and despatched on the next working day should you accept.
• The price of delivery shall be dependant on the total value of your order. Any orders that are of the value £50 and above shall be dispatched for free to addresses on UK Mainland. This offer excludes Northern Ireland, North of Scotland, Channel Islands, Isle of Man, Isle of Wight, Scottish Islands and Republic of Ireland
• There will be a flat delivery charge of £27.99 on all orders to addresses not on UK Mainland
• There is a minimum delivery charge of £4.99 per order, for all UK Mainland orders.
• Delivery times will vary for orders being dispatched to some UK addresses that are on UK Mainland. Deliveries to some UK Mainland postcodes, Northern Ireland, North of Scotland, Channel Islands, Isle of Wight and Scottish Islands may take 2-3 working days. Delivery charges can be viewed at the checkout before placing your order.
• In the event that no-one is available to receive the delivery, a card will be left providing you with the option to have the item delivered at a later date.
Returns
• All returns must be made with the contents in a re-sellable condition.
• Chocolate Moment will not accept returns that have been opened, tampered with or any product that has been specially ordered in by us.
• The cost of returning the goods will be the responsibility of the buyer and not Chocolate Moment. A refund of the order will be given once the goods have been checked to be satisfactory by Chocolate Moment.
• If you are not fully satisfied by the product, you may return them within 7 days of receipt to: Customer Returns, Chocolate Moment, 124 Stansfeld Street, Blackburn, Lancashire, BB2 2NG. Please ensure that you include all your contact details, any reference labels related to the product (order ID) and details of the problem.
• Returns made after 7 days of receipt will not be accepted by Chocolate Moment.
• Chocolate Moment will try to ensure that all products are dispatched in perfect condition. We cannot accept damages to the products due to climate conditions after dispatch – e.g. chocolate melting due to exposure to heat.
Risk and Property
• Chocolate Moment will not be held responsible for any damage caused to your order during transit.
• These Terms and Conditions and anything offered on chocolatemoment.co.uk hold no warranty or guarantee. Therefore, the use of our website and services will be at your own risk.
• Chocolate Moment will not be responsible for any loss, financial or otherwise, due to the unavailability of the website.
• Compensation shall not be offered for any loss or damage caused by our website through virus or human error.
• All products at chocolatemoment.co.uk remain the property of Chocolate Moment until full payment of goods has been received.
• Chocolate Moment retains the right tot cancel any order up until the time of dispatch.
• These are the Terms and Conditions of Chocolate Moment; if however, you do not agree we advise you to refrain from using our website and service immediately.
Copyright and Trademarks
• www.chocolatemoment.co.uk, and any materials related to our company, such as the name, logo, text, photographs and graphics remain the property of Chocolate Moment.
• Duplicating any part of our website is strictly prohibited without the consent of Chocolate Moment.
General
• Chocolate Moment shall not be held liable for any costs and/or problems occurring from any cause beyond our reasonable control.
• Any changes made to these Terms and Conditions shall be posted on chocolatemoment.co.uk, and shall include the date when the alterations were made.
• Any part of this agreement found to be invalid will be removed; however, the rest of the agreement shall remain valid.
• This agreement shall bid all parties until the order is collected by the carrier and is accepted by you.
